Terms and Conditions
The following are our terms and conditions of business, in all of the text hereafter ‘we’ means ‘Gallery136 Limited’ and ‘you’ means the ‘customer’.
1. All goods must be paid for in full prior to delivery / collection. 2. All goods remain the property of ‘Gallery136 Limited’ unless paid for in full. 3. We shall not be liable for any loss or injury whatsoever, to persons or property suffered as a result, direct or otherwise, of any goods supplied by ourselves. 4. It is our policy to provide accurate photographs and descriptions of our goods. However due to the nature of our products and the limitations of photographic reproduction, there will always be variations in size, colour, shape and wood grain. It is for this reason we suggest a visit to our showroom before placing your order. Any of these variations do not represent a faulty product, but merely enhance its original hand made natural appeal. 5. Manufacturers sometimes change details without our prior knowledge. As this is beyond our control we cannot be held responsible for any minor changes. 6. Once you accept delivery of an item, if you find a fault, you must inform us by telephone or e-mail, within 24 hours. With a minor fault we will try to rectify it. However if the fault is more serious we will usually offer a like for like replacement. 7. If once you accept delivery of an item you decide, for whatever reason you no longer require that item you must inform us in writing (e-mail acceptable) within 3 days. The item must be returned to us undamaged and unused, in all the original wrapping (unwrap carefully) and in such a condition to enable us to re-sell it as new. Any carriage costs for delivery to you and the return journey will be borne by yourselves. Even if we originally delivered the item to you free of charge, this journey will now be chargeable. Each circumstance will be judged on its own merit, but as a guide, the minimum delivery charges will be £20 each way. There will also be a handling charge of 15% for stock items and 30% for non-stock items. (This can even apply if you cancel before receiving the goods). Any special order items cannot be returned, except at our discression, whereupon a 60% handling charge will apply. The golden rule must always be to check and re-check all measurements (including access routes). Hand made goods vary in size from piece to piece, so if your measurements are tight please refer. Always be sure of the product you are ordering. We would prefer that you asked lots of questions upfront rather than cancelled your order further down the line. As this would be a fruitless exercise for all concerned ! 8. Delivery dates are given as an estimate (guides to maximum expected lead times can usually be found at the bottom of product pages on our website). Our company policy is always to err on the side of caution, this means that quite often you may receive your delivery earlier than expected. However the nature of hand made products and shipping from the far corners of the globe, mean that occasionally you may experience delays. If for any reason the delay goes on for more than 30 days past your longest estimated delivery date, you may upon request, cancel your order and receive a full refund of any monies paid. 9. In the unlikely event of an item developing a subsequent manufacturing fault within 90 days of delivery, we would, with a minor fault attempt to rectify it in situ. However if the fault was more serious we would remove the item for repair or if repair was not possible, consider a full replacement. (Please note occasionally small cracks or small amounts of movement can occur in solid wood furniture. These are not considered faults but are a result of movement and settling in a modern home environment – please see the product care section on our website for advice on caring for solid wood furniture) 10. Due to the nature of all the environmental factors and also the stresses and strains furniture can be put under, that is beyond our control, we cannot accept responsibility for any problems occurring after this 90 day period has elapsed, however, at our discression, we will do our best to assist you after this time, within reason. 11. Any Credit /Credit Notes issued must be redeemed within 90 days or you will lose any entitlement to the aforemention credit that was offered due. 12. We will only accept responsibility for the first £100 of any damage to property or persons as a result of the delivery of goods by ourselves or our sub-contractors. Therefore please make sure that all routes are clear of obstruction and please be on hand to supervise and or direct our operatives. Any claim of damage must be directly brought to the attention of the delivery operative/s at the time of incident and noted on delivery sheet when signing for goods. 13. Any Special Order Items will be manufactured on the basis that you, the customer, has made all appropriate checks to ensure that the item will be suitable for its intended purpose. Futhermore, this responsibility will be entirely yours, and any advise given by us should be regarded as opinion rather than fact. 14. By placing an order with, or making a purchase from 'Gallery 136 Limited', you will be deemed to be agreeing to and entering into a contract, based upon all of the above terms and conditions.
